Judge Denlow has settled over 100 class action cases during his judicial and JAMS careers. Class actions present a number of unique issues in negotiating a settlement. This program will discuss steps practitioners can take to help facilitate a successful mediation of their class action case.

    Perceptions of the goals of the mediation and of the relative roles of attorney and client in the process will often determine the form of the mediation, the choice of the mediator and the mediation process itself. As the concept of mediation evolves from court conducted settlement conference to a broad based problem solving process, the roles and functions of the attorney-representative in mediation are also changing in ways that are not always appreciated, especially when the focus of the dispute is broader than mere legal rights and liabilities.

    ADR has matured. There is no "Best Way." Experience over the last 30+ years has, however, taught that some practices are more effective than others, and that there is a growing body of ethical considerations which inform the quality of the mediation or arbitration process.

This will be a practical, interactive workshop. We encourage participants to submit particular issues which could be "better handled in the future" to Michael McCants at mmccants@jamsadr.com prior to June 20.
