The JAMS Global Engineering and Construction Group provides expert mediation, arbitration, project neutral, and other services to the global construction industry to resolve disputes in a timely and efficient manner. Philip L. Bruner serves as Director of the group.
The JAMS Global Engineering and Construction Group includes a team of mediation and arbitration experts with subject matter expertise spanning the construction industry. Few projects are truly local in our flattening and competitive world and our neutrals cross cultural and national boundaries, regardless of whether the project is small or large.
Resolution options offered by JAMS include project neutrals and dispute review boards selected from our panel of prominent engineering and construction experts. These ADR specialists also serve the industry as mediators, arbitrators, discovery referees and special masters.
ADR Options
Mediators/Arbitrators – Members of the JAMS Global Engineering and Construction Group serve as mediators and arbitrators throughout the world in disputes involving large projects, such as: educational institutions, bridges, corporate headquarters, government buildings, hospital and medical facilities, nuclear power plants, sports stadiums, among other complex and high-profile projects. Our neutrals often serve as single arbitrators and on three arbitrator panels.
Project Neutrals - Before a large construction project begins, many owners, contractors, and architects designate a project neutral in their contracts. These trained ADR specialists become part of the construction team and follow the design and building process from concept to completion. The role of the Project Neutral applies the benefits of mediation in an informal, cost-effective manner to the overall design and construction process.
Unlike any other member of the team, the project neutral only has one client – the project. The project neutral gains the team’s trust and can meet with members privately to discuss any concerns about keeping the project on time and within budget. The project neutral is available on an as-needed basis, not only to mediate disputes as they arise, but also to avoid future litigation by identifying and addressing potential problems.
Dispute Review Boards – During the design and construction phases, JAMS ADR specialists work with the parties to resolve complex issues which can delay or otherwise jeopardize a project.
With their engineering, construction and legal backgrounds, JAMS neutrals are uniquely qualified to serve on dispute review boards which support the project over its lifetime. They understand the complexity of project financing and the demands of multinational mega-projects with numerous participants.
