Hon. Edward A. Bobrick (Ret.), a highly experienced and well regarded trial judge, has over the course of fourteen years as a Magistrate Judge in the U.S. District Court for the Northern District of Illinois, mediated and settled in excess of 1,200 cases, each having factual and legal issues that touched upon virtually every aspect of federal law, or that dealt with a wide array of issues associated with complex business litigation brought under diversity jurisdiction.

ADR Experience and Qualifications

Judge Bobrick has tried, arbitrated or conducted settlement conferences in cases involving the following issues.
  • Business/Commercial: disputes involving licenses, franchises, anti-compete clauses, lease agreements, royalty claims, accounting, contract interference, contract performance, purchase and sale, insurance, and Illinois Uniform Commercial Code
  • Civil Rights: constitution violations, Individuals with Disabilities Education Act (IDEA), and Title IX claims
  • Employment/Labor: discrimination, wrongful termination, retaliation, sexual harassment, Fair Labor Standards Act (FLSA), Title VII, Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), and Employee Retirement Income Security Act (ERISA) claims
  • Environmental: pollution, contamination, and remediation disputes, in particular, cases brought under the Comprehensive Environmental Response and Compensation and Liability Act (CERCLA) and Resource Conservation and Recovery Act (RCRA)
  • Insurance: commercial disputes involving duty to defend and indemnification, and disputes over claims for health and disability benefits
  • Intellectual Property: infringement or validity of patents, copyrights, trademarks, trade name, trade dress, and trade secrets disputes
  • Personal Injury: all types of cases brought under diversity jurisdiction, and injury claims under Federal Employees Liability Act (FELA), Jones Act, Federal Tort Claim Act (FTCA), and Occupational Safety and Health Act (OSHA)
  • Securities: investor loss claims

Representative Matters

  • Issued a 200 page Arbitration Award in a $3 billion dollar complex breach of contract claim involving the contested termination of an international exclusive consumer packaged goods distribution agreement between two major food and beverage businesses. ($2.7 billion awarded as the Fair Market Value of the terminated contract along with $15 million in attorney fees)
  • Arbitrated a $5 million breach of contract claim involving a national Internet Service Provider and one of its sub-contractors over compliance with the contract's compensation provisions
  • Special Master of multi-million dollar intellectual property dispute involving misappropriation of proprietary trade secrets, patent validity, and rightful ownership to patent applications. The patents involved related to networking of electronic transmission of telecommunication data
  • Mediated settlement of a $60 million ERISA class action lawsuit
  • Mediated settlement for denied identification and cost of defense claims in excess of $40 million made by large national industrial manufacturer against large insurance casualty carrier
  • Settled million dollar patent infringement claim made by large manufacturer of electronic communication equipment against a competitor
  • Settled million dollar trade secret claim made by large manufacturer of high pressure hydraulic cylinders made against departing officers and employees
  • Settled a significant number of cases involving the terms and royalties involved in exclusive license agreements; i.e., business management software, commercial food processing equipment, high-end coffee products and commercial coffee brewing machine
  • Mediated global resolution to a large number of class action lawsuits brought against automobile dealers in the Chicagoland area involving claims under the Fair Debt Collection Act
  • Resolved a multi-million dollar class action age discrimination case involving an international airline purchase of additional overseas routes from another airline
  • Resolved in excess of 400 employment discrimination class claims
  • Automotive dealer franchise termination dispute
  • Corporate executive contract dispute involving salary and bonus claims
  • Fee dispute by telecommunication and forensic accounting expert
  • Dispute involving non-compete clause in sales/employment contract
  • Settled significant Jones Act claim by injured seaman
