A retired senior justice of the Appellate Division of the New York Supreme Court and former Commercial Division Justice, Judge Crane has confronted simple and complex insurance litigations and appeals as a judge.  Judge Crane has had a substantial caseload in mediating, arbitrating and evaluating insurance issues as a neutral since joining JAMS.

  • Mediated claim of insurer in liquidation to retroactive calculation of premiums and deductibles in workers’ compensation coverage
  • Mediated subrogation claim arising from settlement of personal injury action caused by defendant’s insured’s legal malpractice
  • Arbitrated claim to insurance proceeds of policy insuring against adverse consequences of Internal Revenue Service audit of deductions for contributions to premiums paid by an employer to a life insurance plan covering certain employees
  • Mediated subrogation claim for the destruction, by errant temperatures of cooling equipment, of organic material used in developing an experimental cancer vaccine with complicated accounting issues in the calculation of damages 
  • Mediated claims in a declaratory judgment action among insurers and one of the alleged tortfeasors whose late notice triggered a disclaimer by one of the insurers including a proposal for a fronting agreement among all of them in mediating an underlying personal injury claim
  • Subrogation action to recover sums paid to insured when prospective buyer of property made subsurface drilling holes piercing the insured's subsurface electrical conduits
  • Coverage dispute under all risks policy for failure of insured's customers to repay gold tubing with equivalent weight in gold
  • Mediated claims to retroactively recompute workers' compensation promises steaming from a reclassification of employees by the Classification Insurance Rating Board
  • Mediated claims to proceeds of life insurance policies withheld during contestability periods on grounds of misrepresented actions and omissions on applications and statements of good health
  • Arbitrated claims to damages under Bermuda form excess insurance policy covering mass tort actions alleging product liability of a pharmaceutical manufacturer involving questions of what the manufacturer ”expected” as “intended” the claims to be
