Representative Matters

  • Determination of allocation of responsibility for toxic cleanup and liability for damages between various leasehold interests on property at one time utilized as a car dealership. Involved interpretation of numerous agreements between multiple parties and successor parties and determination of issues of indemnification as between the respective parties.
  • Determination of change in leasehold interest rate based upon provisions of long term lease and required determinations based upon the appraisal and valuation of the property in question.
  • Development dispute between two public entities over land use which required the consideration and determination of rights and obligations pursuant to the applicable state environmental laws.
  • Dispute between a private developer/land owner and a public entity over property rights including issues involving tidelands and entitlements. This case involved analysis of technical issues as to scientific means of determining whether certain land was tidelands at the time of California statehood which was critical to the entitlement issues in addition to title questions.
  • Tenant improvement case where claims were based on disputed change orders and sought delay damages in excess of $2M. [Total project in excess of $8M]
