Mr. Kurland was recently selected by the Daily Journal Extra as one of California’s 20 Most Sought-After Neutrals. He is a full-time mediator, arbitrator and referee specializing in the resolution of complex multi-party, multi-issue cases. His extensive legal and business background and strong management skills have enabled him to consistently and efficiently settle large-scale disputes.

Mr. Kurland previously served as in-house counsel to a large real estate development company whose projects included commercial, industrial, hotel, apartment and residential community projects. One of Jerry’s primary responsibilities was the management and negotiation of settlements of company litigation, which included numerous complex matters and involved direct working relationships with large homeowner associations and the company’s insurers, lenders and partners.

After mediating and arbitrating for several years as a member of the national panel of mediators and arbitrators of the American Arbitration Association, Mr. Kurland became one of the first attorney-mediators affiliated with JAMS in Southern California. He has also served as a judicial arbitrator, settlement officer and judge pro tem in the Los Angeles courts.

Representative Matters

  • Construction Defect: settled hundreds of construction defect cases, including commercial, public works, multiple single-family-home and condominium developments. Cases usually involve difficult insurance coverage issues and include anywhere from 2 to 200 parties.
  • Construction: (on the job problems) - numerous cases involving claims for payment, delay damages and mechanics lien issues.
  • Environmental: dispute among owner, contractor and subcontractor relating to toxic waste clean-up and disposal, including issues involving reimbursements from state underground storage tank fund.
  • Inverse Condemnation: actions involving municipality and single-family home slope failures.
  • Landlord/Tenant: arbitrated and mediated rent disputes and matters involving construction of tenant improvements.
  • Public Works: actions involving construction of roadways, recreational facilities, agricultural water pipeline, flood control channel, freeway sound-wall and downtown revitalization projects.
  • Real Estate: many disputes (including claims of fraud and misrepresentation) among sellers, buyers, brokers and/or escrows arising out of purchase and sale transactions, including claims for specific performance and rescission.
