Donald L. Morrow, Esq. is a full-time neutral with JAMS who brings more than 40 years of significant trial and litigation experience. He specializes in resolving a wide variety of disputes, including complex commercial, class action, intellectual property, technology and antitrust and unfair competition issues.

As an attorney, Mr. Morrow concentrated his practice in complex commercial and class action litigation, and tried more than 40 cases to judgment, both jury and non-jury. He also regularly litigated cases in connection with technology and intellectual property matters, including patent and trademark claims. Additionally, he litigated many antitrust and unfair competition cases under both federal and state laws. Having tried extremely high profile cases, Mr. Morrow is experienced in handling the sensitive issues surrounding such cases.

Antitrust/Competition Law

  • Tried multidistrict litigation (MDL) antitrust action that included allegations of price fixing in the chemicals industry against a Fortune 100 company
  • Lead counsel in MDL federal antitrust case in Los Angeles involving allegations of price fixing in air passenger travel between the United States and Korea that was settled through mediation
  • Lead counsel in MDL antitrust case in New York involving allegations of price fixing in air cargo transport industry that was settled through mediation
  • Tried action for unfair competition brought by author of a book on auto mechanics against the publisher of another book on auto mechanics with a similar name


  • Tried possibly the largest shareholder appraisal case ever tried to conclusion; trial lasted 17 months in Michigan and involved claims exceeding $800 million
  • Served as counsel in a RICO and fraud class action where damages sought exceeded $8 billion
  • Served as counsel in a fraud and contract case involving claims related to the financing of a major master-planned residential community in Montana
  • Tried fraud, breach of fiduciary duty and breach of contract action brought by buyer of polyurethane gloves business from major chemical company
  • Tried breach of contract action brought by ground lessee of major sports stadium against its landlord to enjoin the development of a major commercial development on the parking lot surrounding the stadium; trial lasted 13 months
  • Tried claim by partner in joint venture that owned multiple major apartment complexes for breach of fiduciary duty and breach of the partnership agreement; case settled through mediation while on appeal
  • Lead counsel in breach of lease action between regional shopping center owner and tenant of 60,000-square-foot space; case settled through mediation
  • Lead counsel in action to terminate lease of railroad spur due to the alleged untimely exercise of option to extend the lease; case settled through mediation
  • Tried contract and fiduciary duty action between two partners who were developing 240-unit apartment complex in Maui, Hawaii
  • Tried dispute between motorcycle dealer and distributor involving claims of breach of contract and interference with contract
  • Lead counsel on five-week trial of libel case brought by prominent grape growers against international magazine that published an interview with Cesar Chavez in which he allegedly libeled plaintiffs
  • Lead counsel in action to enjoin development of oil tanks at John Wayne Airport in Orange County, California, brought by owners of property adjoining the airport
  • Lead counsel in action for breach of contract among the partners in a partnership to develop a master-planned residential community in the Bahamas; case settled through mediation
  • Arbitrated dispute among several tire manufacturers who were party to a joint venture agreement for the manufacture of radial tires; case settled through mediation
  • Lead counsel in breach of contract action between owner of regional shopping center and the company that managed the center; case settled through mediation
  • Arbitrated claim by shopping center owner against title insurer involving claim that the title policy failed to identify and except a lease that burdened the shopping center’s parking lot
  • Arbitrated claim by South American petroleum company, which had formed a joint venture with a chemical manufacturer to develop a styrene plant, involving the decision not to proceed with the development of the plant after the market for styrene dropped significantly
  • Arbitrated breach of contract action brought by credit union against automobile leasing company

Class Action

  • Served as lead counsel in federal court class action by homeowners who bought new homes in California from several national homebuilders involving claim that homebuilders concealed fact that they were selling new homes to non-creditworthy borrowers who had a likelihood of defaulting on their loans
  • Lead counsel in class action, brought in Contra Costa County, California, contesting the early-termination provisions of a major automobile distributor’s form auto lease
  • Lead counsel in class action brought on behalf of all dealers who leased their tool trucks from a major leasing company, alleging fraud and unfair business practices
  • Lead counsel in class action seeking the statutory penalty for the alleged untimely reconveyance of more than 30,000 mortgages in California
  • Lead counsel in class action brought against consumer auto lessor, on behalf of all its lessees who resided in California, contesting the late-fee provision in the form auto lease; case settled through mediation
  • Lead counsel in national class action brought on behalf of auto lessees who terminated their leases early 
  • Lead counsel in federal court class action against mortgage servicer on behalf of borrowers who filed for bankruptcy, involving claim that servicer was required by bankruptcy law to negotiate and have the bankruptcy court approve a reaffirmation agreement with its bankrupt borrowers in order for it lawfully to keep collecting on its secured loans
  • Lead counsel in action brought against consumer auto finance company claiming that the form of notice sent by lender to its California auto finance borrowers whose cars had been repossessed violated California law, seeking recovery of all deficiency sums collected by lender 
  • Lead counsel in class action brought against consumer auto finance company involving claim that the company’s practices regarding conditional sale contracts violated the Unfair Practices Act (Cal. Bus. & Prof. Code § 17200 et seq.), the Rees-Levering Motor Vehicle Sales & Finance Act (Cal. Civ. Code §2981 et seq.) and the Consumer Legal Remedies Act (Cal. Civ. Code § 1750 et seq.), and thus afforded all borrowers the right to rescission and restitution of all their loan payments
  • Lead counsel in action brought against mortgage insurer asserting claims of unfair competition and false advertising for the alleged overcharging of borrowers for recording fees in connection with the payoffs of secured home loans
  • Lead counsel in class action alleging that a major leisure company’s travel websites contained misleading and inadequate disclosures regarding certain charges, in violation of the Unfair Practices Act (Cal. Bus. & Prof. Code § 17200 et seq.) and the False Advertising Act (Cal. Bus. & Prof. Code § 17500 et seq.)
  • Served as counsel in class actions brought against one of the largest insurers providing mobile device damage protection


  • Served as counsel in claims brought by multiple homeowners whose property adjoined a slope that failed
  • Served as counsel in action brought by 100-plus homeowners in Murrieta, California, whose new homes suffered differential settlement of up to 15 inches within first two years after construction
  • Lead counsel in defect claim involving major sewer pipeline  

Intellectual Property

  • Tried patent infringement action relating to a single-incision trocar manufactured by major medical device company
  • Handled several patent infringement actions involving medical devices, including prevailing in a jury trial of a patent case involving a device used in laparoscopic surgery
  • Served as counsel in patent and trademark actions brought against entities that manufactured replacement ink-jet cartridges for major manufacturer’s ink-jet printers
  • Served on three-arbitrator panel that resolved software licensing dispute where claimant sought several hundred million dollars

Professional Liability

  • Lead counsel in action for malicious prosecution brought against major law firm
  • Served as counsel in $100-million claim against law firm for malpractice that was settled through mediation
  • Obtained summary judgment in malicious prosecution action filed against law firm

Real Property

  • Lead counsel in arbitration of adjusted ground lease rent for commercial property in Newport Beach, California
  • Lead counsel in trial by reference of competing breach of lease claims brought by parties to lease of a major commercial site at a regional shopping center in Orange County, California
  • Arbitrated dispute between joint venture partners involving a large residential development project planned for Corona, California
