Hon. Richard E. Neville (Ret.) brings over 40 years of judicial and legal experience to his JAMS practice.  Since joining the company in 1999, the Judge has handled hundreds of arbitrations from small business disputes to multi-party, complex matters.  Judge Neville is known for his ability to guide parties and counsel through the arbitration process quickly and efficiently.  In mediation, parties and counsel alike appreciate Judge Neville’s ability to keep parties working until they reach a realistic outcome.

  • Aviation: cases involving manufacturing defects, pilot error, and airline carriers
  • Business/Commercial: numerous contract and other types of business disputes in a variety of industries including telecommunications, manufacturing, intellectual property, investment banking, railroads, and entertainment
  • Class Action: nationwide claims regarding environmental superfund, consumer, advertising and promotional issues
  • Construction: numerous claims involving various types of structures, parties, and issues, including design and work defect allegations, and allocation and insurance coverage issues
  • Employment: numerous discrimination issues including race, gender and age, contract, harassment, and "whistleblower" claims, both class action and individual
  • Insurance: coverage disputes involving reinsurance and multiple carriers; issues included misstatements regarding risks and company policies and procedures in several foreign countries
  • Intellectual Property: computer software and technical disputes, trade secrets, copyright and patent litigation issues
  • Professional Liability: numerous legal, accountants, architect, and engineer allegations of violations of professional standards, negligence, and conflicts of interest
  • Real Estate: resolved numerous disputes involving contractor, contracts, leasing and sales, warranties and insurance coverage, management breach of fiduciary duties, and profit distribution issues

Representative Matters

  • Disputes between sellers and buyers in various businesses, including hospitals and nursing homes, involving issues of "representatives and warranties," interpretation of financial statements, and accounting procedures for asset purchases
  • $15 million dispute between a national insurance company and a software provider regarding the scope and adequacy of performance for a new insurance software product
  • Resolved disputes on appeal between a hospital, its Board of Directors, and the Administrator against two national investment firms for risky and inappropriate investments and subsequent fee disputes
  • Resolved legal malpractice case regarding the defense of a trademark infringement case
  • Mediated the termination of an employment contract between a large REIT company and their in-house counsel
  • Resolved dispute between business software company and former VP-Sales and Services over breach of employment agreement, violation of fiduciary duty and State Trade Secret Act, misappropriation of confidential information
  • Mediated the violation of a licensing agreement of a software company and the misappropriation of protected information; contractual issue of unilateral mistake also involved
  • Dispute regarding the termination of a ten-year lease between a national insurance company and a landlord and the habitable conditions and consolidation of the various property locations
  • Resolved a legal malpractice dispute between the owner of a National Historic site and the general contractor and architect who were hired to refurbish the property
  • Settled dispute over execution of non-recourse notes and mortgages to a REIT that were re-issued several times with different terms and for different projects
  • Legal malpractice claim against medical malpractice attorney for research and evaluation of injury claim, including statute of limitations and statute of repose
  • Settled dispute between general contractor's suit against homeowner of multi-million dollar home regarding issues of delay in completion and compliance with plans and specifications
  • Legal malpractice and breach of fiduciary responsibility for a law firm's representation of partners in several restaurant investments, where attorneys become investors in the business and original partners sued each other
  • Mediated multi-employment terminations by national delivery company for all levels of company employees
  • Settled dispute involving a national hotel chain's lease and financial agreement to build a new hotel; refinancing and construction costs caused a dispute and ultimately the cancelation of the arrangement to lease the property; a suit for damages including lost profits was filed
