Richard E. Posell, Esq.

Mr. Posell has over 40 years of business and entertainment law experience representing some of the most prominent and successful television commercial production companies and directors in the country. He also has extensive experience representing plaintiffs and defendants in real estate, construction, and partnership cases.

Entertainment, Intellectual Property, and Business
  • Arbitrated dispute concerning accounting of fees owed by well-known singer who contested fees claimed by her personal manager; manager defended on the ground that he had performed all services required by his agreement
  • Arbitrated dispute involving investor in a low budget film who claimed that the entity in which he invested failed to report earnings from a television broadcast and other exploitations of the film
  • Arbitrated matter involving sales agent for low budget film who claimed a commission for the sale of the film overseas; at issue was the question of whether the sales agent was the procuring cause for the sale
  • Mediated to settlement a dispute over a claim of fraud in sale of a business
  • Mediated to settlement a complex multi-party international trade dress dispute
  • Mediated to settlement a dispute between two television commercial companies over credits on a director’s reel
  • Mediated to settlement wrongful termination claim in the food services industry
Trade Secrets
  • Represented developer and distributor of document management program in trade secrets dispute which in part involved an understanding of whether a competing system utilized proprietary program information. Trade secret representation extends to cases involving mechanical devices (oil vapor reduction) and chemical (paint), business plans, customers, and customer lists
  • Represented a distributor of a specialized paint product against the trade secret claim of the manufacturer. The case involved understanding the chemistry of paint and manufacturing processes
Class Actions
  • Represented franchisee groups in class actions against the franchisor
  • Defended consumer class action claims for variety of businesses including trade schools, a publicly traded catalogue company, and one of the largest toy manufacturers in the world
