Ralph Levy is a recognized expert in complex financial litigation and has extensive experience in resolving these disputes through ADR. He is a retired senior litigation partner of King & Spalding LLP where he also served for 7 years as firmwide managing partner. Ralph joined the JAMS Atlanta neutral panel after 37 years at his law firm, the last several of which included mediation and arbitration work for which he quickly gained recognition from: Georgia Super Lawyers, Super Lawyers Corporate Counsel Edition, and Best Lawyers in America.

His substantive litigation experience (a common theme of which was its financial orientation in both federal and states courts) extended to business and commercial disputes, professional (accounting, actuarial, and lawyer) disputes, insolvency and fraudulent conveyance disputes arising in Chapter 11 adversary proceedings, real estate, partnership and tax disputes, and securities, merger and acquisition, and post-closing purchase price adjustment disputes. Along the way he represented clients in both mediations and arbitrations and thus has experienced the ADR process from all sides. He understands through experience the major influences of ADR success or failure and has learned to be doggedly persistent in the creative search for success.

    • Long-term contract interpretation disputes between concrete fly ash supplier and its concrete manufacturer customer
    • Casualty and pension actuarial malpractice disputes
    • Fee sharing dispute among class action plaintiffs’ lead and non-lead counsel arising out of approved settlement fund in securities class action
    • “Divorce” of shareholders of closely held company involved in airline food catering business
  • Served as advocate in mediations, including: 
    • Tax shelter (RICO) litigation against national accounting firm
    • Malpractice litigation against consulting actuarial firms
    • Commercial lease dispute
  • Arbitrated as party-appointed neutral panel member in cases involving:
    • Insured’s claims for coverage under tiered excess D&O policies
    • Healthcare contract dispute between insurer and physician group to determine capitation reimbursement
    • Contract reimbursement dispute between national cellular service and a rural roaming service provider
    • Exit disputes between law partners and their former law firms
    • Arbitrated as sole arbitrator a dispute to determine enforceability of damages limitation clause in software development contract
  • Served as advocate in arbitrations, including:
    • Construction contract dispute between condominium association and general contractor and in post-acquisition earn-out dispute between seller and buyer of information services business
  • Served as court-appointed special master:
    • “Auditor” under Georgia statute to make both discovery and merits decisions, subject to appeal to the trial court, in long-term contract dispute between manufacturer of rub-off gaming tickets and its national distributer
  • Litigation experience in accounting/finance, arbitration, banking, bankruptcy, business/commercial (breach of contract, corporate, corporate governance, mergers and acquisitions, partnerships/joint ventures, shareholders’ rights, shareholder derivative actions, and tax), insurance (coverage/reinsurance), professional liability (accountant, legal, actuarial, and directors/officers), real property (commercial leases and purchases and sales), and securities:
    • Represented lawyers, accounting firms, and actuarial consulting firms in a wide variety of professional malpractice cases, some including RICO and securities allegations and some including claims for class wide relief
    • Represented dissenting shareholder in Georgia precedent-setting case setting standard for quantifying appraisal right in short form mergers
    • Represented creditors and others in numerous Chapter 11 adversary proceedings alleging preference and fraudulent conveyance claims
    • Represented information services company in connection with multi-state attorneys general identity theft investigation
    • Represented consulting actuarial firm in class action alleging unfair stock distribution scheme arising from insurance company demutualization 
    • Represented lenders in suits on notes and guaranties, in defense of lender liability claims and in letter of credit disputes
    • Teamed with tax counsel to represent corporate taxpayers in litigated disputes with IRS
    • Represented insurance company seller in post-closing warranty dispute and represented information services buyer in post-closing purchase price adjustment disputes
    • Represented real estate buyer in right of first refusal dispute and commercial tenant in dispute with landlord over renewal terms
