Hon. Mark Whittington (Ret.) is experienced in resolving health care-related disputes, which are often complex and involve rapidly changing laws and regulations. He has served as a mediator and arbitrator for a wide range of claims, including contract disputes involving physicians and hospitals, insurance coverage matters, hearings over peer review procedures, employment claims, and alleged violations of the Texas Prompt Pay Act.

  • Mediated appeal of multi-million-dollar jury verdict in favor of physician for breach of contract against hospital organization that purchased practice
  • Mediated appeal of multi-million-dollar jury verdict in favor of physician against fellow physicians who owned radiological imaging practice for breach of contract, fraud and theft of corporate opportunity
  • Mediated claims by physician against insurance companies for failure to pay under policies for covered procedures
  • Mediated employment discrimination claims by nurses against physicians in vascular surgery group
  • Mediated many personal injury cases involving negotiated resolution and payment of hospital liens
  • Presided over several hearings requested by physicians against hospitals for violations of peer review procedures and denial of privileges
