Zela ''Zee'' G. Claiborne, Esq., a full-time neutral since 1998, specializes in the resolution of complex domestic and international business disputes. As both a mediator and arbitrator, Ms. Claiborne is held in the highest regard by counsel for her exceptional listening skills, fairness, calming influence when diffusing volatile situations, and ability to reconstruct fractured business relationships.

      • Mediation of a design patent dispute involving claims of infringement of five design patents for shoes
      • Arbitrator in dispute among shareholders of a successful online hunting gear business regarding entitlement to acquire shares of its deceased founder pursuant to various contractual agreements (sole arbitrator)
      • Arbitration of a dispute arising out of an Asset Purchase Agreement and a Consulting Agreement between two companies in the wine industry (sole arbitrator)
      • Successful mediation of dissolution of a partnership involved in the edible cannabis business

      • Arbitration of employment claims brought by a female board-certified ophthalmologist and cornea transplant surgeon alleging a wide range of claims including retaliation and emotional distress

      • Claims of age discrimination under the ADEA by a software engineer against a global technology company (sole arbitrator) 
      • Successful mediation settlement of wrongful termination claims brought by a high-ranking consultant to a direct marketing company 
      • Arbitration of multi-million dollar claims against a private equity firm in Boston  brought by an individual recruited to the firm with allegedly false promises that he would receive an equity ownership interest in the firm and other valuable compensation.  This case settled just before hearings (Chair of tripartite panel)
      • Arbitration of claims of discrimination based on race and national origin and retaliation brought by a software engineer against a well-known social media company (sole arbitrator)
      • Mediated resolution of dispute arising out of the termination of employment of an executive. Claims included misappropriation of trade secrets and intentional interference with prospective economic advantage between competing providers of smartphone applications for mobile security and safety services sold to various carrier networks.
      • Mediated resolution of a disability discrimination suit involving a city employee
      • Wrongful termination and gender/race discrimination claims by former employee of large international drug and medical device company
      • Claims of wrongful termination by geotechnical engineer against soils engineering firm
      • Pharmaceutical sales representatives’ claims of wrongful termination allegedly in retaliation for complaints about the employer’s marketing strategies

      • Arbitration of a pricing dispute arising out of a Virtual PPA between owners of a 302.5 megawatt wind farm and one of its corporate offtakers, a company with $11 billion in annual net sales and a global presence, that negotiated for Renewable Energy Credits (RECs) to apply to its worldwide facilities. Respondent asserts pricing should be set at a hub rather than an individual node set forth in the contract. Damages exceeded $60 million. (Sole arbitrator)
      • Mediation of a dispute between the owner of two biomass power generation facilities and a large utility company arising out of long-term power purchase agreements (PPA’s)
      • Mediation of a dispute over the terms of a 20 year PPA between energy purchasers, powers agencies representing several CA counties, and a French solar energy and battery energy storage developer.
      • Arbitration of breach of contract claims by the founders of a utility scale solar company alleging entitlement to a share of a $2 Billion sale of equity in the company. The founders left management of the company in the hands of two large lenders upon execution of Separation Agreements entitling them to a portion of the upside of a successful sale (sole arbitrator)
      • Arbitration of claims brought by an innovative utility scale solar and energy storage company and a group of investors with a New York private equity firm. The parties disputed the control and ownership of a Joint Venture they had formed for the purpose of financing and developing a pipeline of 73 large solar projects (sole arbitrator)
      • Mediations of disputes arising under the PPA’s and IA’s of several solar companies involving claims for indemnity against a major utility for damages allegedly incurred in connection with the Chapter 11 bankruptcy of the utility
      • Mediation arising out of a contract to develop and service a Balancing Authority for a natural gas-powered electrical generation facility 
      • Mediation of a contentious dispute between erstwhile partners in an oil and gas venture

      • Resolution of a dispute between a large oil and gas company and a local utility arising out of the Force Majeure provision of their PPA

      • Claims for breach of contract and violation of the Trade Secret Act involving electronic communication systems brought by a developer of personal distress alarms used in state hospitals for staff safety against a large telecommunications company (sole arbitrator)

      • Successful resolution of a dispute between a company in the U.S. and a Taiwanese Company in the business of making computer parts, including routers. Multimillion dollar settlement of claims for false advertising and unfair competition.
      • 8. Mediation of a dispute over the terms of a 20 year PPA between energy purchasers, powers agencies representing several CA counties, and a French solar energy and battery energy storage developer.
      • Chair of the Tribunal for an Arbitration of the claims of a petrochemical company against an international terminal company for over $50 million in damages arising from a fire and discharge of chemicals in a ship channel. Damages claims included lost product, the cost of substitute storage and terminal services, and handling air and water pollution. (Chair of the Tribunal, ICDR Rules). This case settled approximately a month before hearings were to begin. (Chair of tripartite Panel)
      • Sole Arbitrator for dispute between a digital cryptocurrency exchange and one of its customers in the U.K. Claimant is a global cryptocurrency exchange on an electronic trading platform that assists trades of legal tender for digital assets. 
      • Mediation of a dispute over the terms of a 20 year PPA between energy purchasers, powers agencies representing several CA counties, and a French solar energy and battery energy storage developer
      • Arbitration of multi-million dollar coverage claim by a distributer of tires in the U.S.  against a London insurer for breach of a Defense Funding Agreement.  The underlying litigation involved claims of defamation and deceptive trade practices brought against the insured U.S. company by its manufacturer in China (sole arbitrator)
      • Arbitration of an international dispute arising out of a Stock Purchase Agreement between the founder of a technology company with offices in Columbia and Romania, and a global company specializing in home automation and wireless security (sole arbitrator)
      • Mediation of a dispute between a U.S. company and the government of a Eurasian country regarding control of an oncology center
      • Mediated resolution of a dispute arising out of a Commission Agreement between a broker-dealer in California and a seller based in Hong Kong regarding a multi-million-dollar sale of the stock of a pre-IPO online e-commerce company
