Ethics and Professionalism in Mediation: Ethical Issues Faced by Mediators and Advocates
The panel will share advice on how to recognize and solve potential ethical issues in the mediation process. How do advocates walk the fine line between puffery and lying? How do mediators move from a conceptual understanding of the Model Standards of Conduct for Mediators to applying the rules in specific cases. What guidance do mediators have for appropriate actions? Perhaps more importantly, what potential sanctions do mediators face if they violate an ethical rule? Does the answer differ for attorney-mediators and non-attorney mediators?
