Coverage litigation is exploding with hundreds of filings to date, and many more on the way. Legislatures have explored intervention while insurance regulators have sought information on what is covered by the insurers. As of writing, over two hundred cases have been filed by policyholders and insurers. These cases touch on a broad range of issues but are primarily focused on business interruption claims. Some of them seek expedited or specialized relief in the form of class actions, MDL proceedings, and/or injunctive relief. Motions to dismiss are being briefed in some of the actions and it appears likely that the first ruling will be on a preliminary injunction application in the Southern District of New York.
