In intra-family trust and probate litigation matters, there are often beneficiaries who simply do not want to litigate against their siblings, parent or step-parent, or children. Cases are often directed to mediation, and the non-participants fail to appear. This is an area of the evolving case law in California, but it appears the mediating beneficiaries may now be free to discount or otherwise negotiate the claims or shares of those who fail to attend.
