Advocacy and zealous representation of clients can lead practitioners into ethical thickets. You’ll enjoy the use of the fan favorite—hypotheticals—and a discussion of practical ways to navigate your way through these sticky situations. Topics will include:
- Ethical issues while using generative AI
- The use of listservs
- Drafting settlement agreements
- Duty to inquire into circumstances of client representation (e.g., to avoid assisting fraud or crime)
- Attorney communication with represented party
- Witness preparation
- Failure to disclose that the plaintiff/client has died of unrelated causes before mediation
- Announcing a hard limit on settlement authority at the outset of mediation
- Failure to have a client present for mediation when the Neutral requires it
