Judge Brazil will present a paper to scholars from around the world that provides an overview of the history of ADR in the United States, but whose principal purpose will be to use a close examination of the ADR Multi-Option Program in the U.S. District Court for the Northern District of California to explore how levels of "formalization" of ADR processes affect their character, their utility, and their attractiveness to potential users.
