Event Mediating Cyber Claims Arising Under Insurance Policies

Over the course of the last decade, cyber insurance has developed from an obscure insurance "add-on" into its own industry with policies nearing $500 million dollars. Since the industry is still very young, often policies can be imprecisely drafted, or unclear on certain technical issues. Drafters are getting better, but until the day comes when policies will be routine, those who have a cyber claim face a daunting task in the courtroom. That is why claimants and insurance companies are turning to mediation to try to solve the puzzle of their policy and achieve the best possible outcome.

This presentation will include a general overview of cyber insurance, a sampling of policy language, and tips on what advocates and neutrals should focus on when mediating these claims.
