Mediation can be an effective and efficient way to bring cases to closure. But ethical considerations abound for both lawyers and mediators, including confidentiality, conflicts of interest, duties of fairness and candor, and the obligation to advance the client’s objectives. The panel will present and discuss several hypothetical ethical issues that are unique to the mediation setting and require thoughtful consideration and difficult discussions.
