Boston Bar Association: Advanced Issues in Mediating Business Disputes

Boston Bar Association: Advanced Issues in Mediating Business Disputes

Presented By: Boston Bar Association’s Business and Commercial Litigation Section

About the Event

Business disputes are often complex, and challenging issues tend to arise in mediating business controversies:

  • How does the background of the business mediator you choose send signals and influence the mediation process?
  • What is the best way to structure a mediation statement to have the most impact? • How does one successfully use experts or “defend” against their use?
  • What are the best ways to handle multi-party situations?
  • What considerations are involved with a mandatory mediation that was previously stipulated to by party agreement?
  • How are facilitative and evaluative approaches balanced throughout the mediation process?
  • What are the benefits and drawbacks of involving a “mediator’s proposal” to resolve disputes?
