In this program, panel members discuss Georgia’s Apportionment Statute and how apportionment and offers of settlement are two “wild cards” that act as game changers in settlement negotiations. With the passage of tort reform in 2005, the apportionment statue dramatically change the legal landscape and the applicability of joint and several liability. The panel will discuss apportionment issues in the context of litigation and mediation.
