As IP disputes become increasingly complex, time-consuming, and costly, alternative dispute resolution (ADR) mechanisms, particularly mediation, attract increasing attention as potential solutions. This panel will explore the latest trends in mediation within the IP sphere, highlighting its advantages and limitations compared to traditional litigation and arbitration. In addition to reviewing recent trends and emerging best practices, the Panel will discuss the strategic use of mediation, as well as challenges and resistance that seem to exist in some circles. Furthermore, the role of Courts in accepting, incentivizing, and even mandating mediation will also be under review, including a comparative analysis of judicial approaches across jurisdictions.
