To Arbitrate, or Not to Arbitrate, That Is the Question

With the uptick in mass arbitrations and the exposure that can result from them, companies have questioned both whether to have and whether to enforce an arbitration clause. The answer to each question is nuanced and often company-specific. But there are common considerations that should inform the answers to these questions and the specific language of the arbitration clauses. This panel will provide legal developments regarding arbitration clauses and their enforceability, strategies on drafting and enforcing arbitration clauses, and the process of navigating a mass arbitration.
