This program examines practical strategies for enhancing arbitration efficiency while preserving a fair and cost-effective process. Aaron Gothelf and Hon. Sandra Margulies (Ret.)  will discuss how well-crafted arbitration clauses, targeted and proportionate discovery, thoughtful arbitrator selection, the efficient presentation of evidence, limiting the use of experts, utilizing virtual hearing technology, and conducting early mediations can expedite resolution without compromising quality. The program will also address best practices for appellate arbitrations, including drafting clauses that clearly define the scope and standards of review, setting sensible timelines, organizing the record to facilitate streamlined appellate consideration, structuring effective briefing, and managing costs associated with multi-tier proceedings.
