The panel will explore key ethical issues facing lawyers and neutrals in mediation, with a particular focus on the significance of ABA Formal Opinion 518. Discussion topics will include why attorneys may ethically posture and engage in puffery during settlement discussions, while attorney-mediators have a duty to “play it straight.” The panel will also examine the impact of Formal Opinion 518, including whether mediators can ethically make mediator’s proposals, and will address common ethical challenges confronting attorney advocates in mediation.
