This session will explore emerging legal challenges in digital advertising that directly impact trademark and branding professionals. Key topics include the legal implications of AI washing - misleading claims about artificial intelligence in advertising - and the regulation of dark patterns, a term that refers to deceptive user interface designs. The session will draw on findings from a global advertising law survey conducted by the Commercialization of Intellectual Property Committee, covering 75 jurisdictions. While not all results will be discussed, the survey provides valuable context for understanding how digital advertising trends are shaping trademark counseling across diverse legal landscapes.
