JAMS neutral David M. Schoeggl, Esq. will cover the historical background of the decision, including the development of Cumis counsel cases, related statutes, and the ethical rules in place before Tank. It will also examine the Tank decision itself, its rules for defense counsel, how those rules apply inside and outside reservation-of-rights defenses, and practical approaches to compliance in light of later legal interpretations.
