Linda M. Burrow, Esq., brings a unique combination of legal experience and business acumen to her mediation and arbitration practice. Described by clients and colleagues as able to “efficiently and effectively grasp complex cases and legal problems, Ms. Burrow is praised for her “real world experience” and as an “exceptional listener” and “skilled communicator” who is “able to connect with corporate and individual clients of all stripes and levels of sophistication.” In addition to her broad and varied substantive experience, Ms. Burrow brings to JAMS a wealth of experience in arbitration, mediation, court litigation and appeals.

Ms. Burrow’s legal experience spans across industries and borders. Immediately prior to joining JAMS, Ms. Burrow served as Vice President and Global Head of Litigation for Netflix, Inc., where was responsible for developing dispute resolution strategy and advising senior executives on legal, business and reputational risk around the globe. Prior to Netflix, Ms. Burrow spent twenty years in private practice, where she represented plaintiffs and defendants both within and outside the entertainment industry in myriad matters, including complex commercial disputes, employment matters, patent, trademark, copyright and defamation claims, trade secrets misappropriation matters and securities and consumer class actions. Ms. Burrow’s practice has extended globally throughout her career, including cross-border licensing disputes involving parties in Taiwan, India and Germany and supervising litigation in jurisdictions as varied as Korea, Brazil, France and the United Kingdom.

Ms. Burrow has a Bachelor’s degree in Chemical Engineering, and spent nine years prior to law school in various engineering, planning and financial analysis positions at a major oil and gas refining company, experience that informs Ms. Burrow’s technical literacy and forms the foundation of Ms. Burrow’s analytical and business prowess.

Ms. Burrow has represented clients in dozens of mediations, and understands the strategic, economic and human considerations that drive resolution. Building on her experience leading teams in arbitration, as well as litigating in trial and appellate courts, Ms. Burrow understands the value of preparation, candor and case management in helping parties resolve their disputes.

Business Commercial

  • Represented party in purchase price adjustment proceeding following multi-billion acquisition 
  • Represented parties in contract claims for sale of equipment and software to government agencies 
  • Represented real estate developer in contractual and construction defect claims 
  • Represented LLC members in arbitration hearing over ownership and operation of Los Angeles office buildings 
  • Represented parties in dispute over rights to modify or decommission coal-fired energy cogeneration plant 
  • Represented client against antitrust action brought by competitor for government contracts 
  • Led arbitration team in contract dispute between celebrity news website and former operator of its branded bus tour

Class Action

  • Represented movie theater chain against class action involving alleged violation of laws regarding information on credit card receipts 
  • Represented film studio in putative class action regarding content and materials in special edition DVDs

Employment Law

  • Represented entertainment company in action alleging wrongful termination on the ground of gender, race and sexual orientation discrimination
  • Led arbitration team in wrongful termination and discrimination claim brought by talent agent against his former agency
  • Managed litigation involving claims of discrimination and retaliation in payments to on-screen talent
  • Represented clients in wrongful termination claims and tort claims brought against radio station by talent who were terminated for on-air statements
  • Represented employers in ERISA employee benefit claims
  • Directed litigation in interference lawsuit between two studios in which one studio hired other studio’s employees, who were under personal service contracts
  • Performed confidential internal investigations of misconduct allegations against company executives
  • Advised senior leadership on employment risk in connection with sensitive, high-profile claims

Entertainment & Sports

  • Led trial and appellate team in case involving an alleged failure to pay profit participations from home video distribution of popular film 
  • Represented parties in disputes between talent management firms and former employees over commission payments 
  • Litigated claims brought by public and private figures alleging they were defamed by their depiction in news stories, documentaries and fictional works 
  • Represented music company in right of publicity claim alleging that a recording artist had adopted the plaintiff’s persona 
  • Litigated numerous copyright infringement actions ranging from claims involving music compositions and sound recordings, alleged infringement of scripts and treatments for television series and films, use of music in films and use of pre-existing material in documentary productions 
  • Represented reality television producers in matters involving breaches of non-disclosure agreements by employees and participants 
  • Represented parties in accounting disputes over royalty, net proceeds and commission payments

Governmental & Public Agency

  • Oversaw response to various subpoenas and investigation demands from federal and state regulatory agencies 
  • Directed class action defense in multiple jurisdictions relating to tax liability of internet streaming services

Intellectual Property

  • Directed patent litigation in United States, German and Dutch courts 
  • Led arbitration team in trade secrets action relating to arising from the alleged use of claimant’s streaming technology 
  • Represented software developer in trade secrets misappropriation claims against former employee 
  • Represented parties in copyright and trade secrets disputes arising from former employees’ and executives’ alleged use of company intellectual property while employed by competitors 
  • Litigated trademark infringement claims arising from the use of plaintiff’s mark in expressive works 
  • Litigated copyright and trademark claims arising from alleged use of the plaintiff’s work in textiles and restaurant decor

International & Cross Border

  • Oversaw global litigation portfolio for industry-leading streaming entertainment company, including copyright, patent, defamation, image rights, contract, taxation, and regulatory-related matters in territories including Korea, India, Brazil, Mexico, Peru, France and the United Kingdom
  • Represented U.S. film and television studios in disputes with licensees located outside the United States, including in India, Taiwan and Germany
  • Represented U.S. cable channel in carriage dispute
  • Managed UK contract litigation relating to defects in property leased for use in television production
  • Litigated disputes in US, German and Dutch courts arising from international distributors’ breaches of television distribution contracts
  • Led trial team in bankruptcy proceeding over the proper interpretation of German bankruptcy law
