Giuseppe De Palo, Esq., is an international mediator and arbitrator who has spent nearly 30 years helping companies, governments and NGOs resolve high-stakes conflicts quickly and cost-effectively. Recognized worldwide for his work, he has guided more than 2,500 disputes to settlement across 60 countries and among parties from more than 90 nations. In his decades-long career in ADR, he has mediated and arbitrated a wide spectrum of single- and multi-party cross-border disputes in diverse areas including complex business and commercial, intellectual property, banking/financial services, construction, energy, tort and insurance law.

In recent years he has devoted particular attention to global trade mediation, guiding exporters and importers through conflicts triggered by sanctions, supply chain breakdowns, and geopolitical turbulence in an age of fast-changing regulations and volatile markets. He has also advised multinational corporations, public institutions, and international bodies on integrating environmental, social, and governance (ESG) principles, including alignment with the United Nation’s (U.N.) Sustainable Development Goals (SDGs), into their operational and trade practices. 

Based in New York City, Mr. De Palo also maintains an active domestic practice. He has mediated complex business and commercial, partnership, employment, real estate, and tort disputes among U.S. parties in both state and federal forums. His employment experience includes matters involving discrimination (race, gender, age, disability, sexual orientation, and national origin), harassment, retaliation, hostile work environment, wrongful termination, sexual assault and related misconduct, and whistleblower protection, often involving senior executives and C-suite leadership. These matters arise under federal and state frameworks, including Title VII of the Civil Rights Act, the New York City and New York State Human Rights Laws, and analogous statutes across jurisdictions.

Mr. De Palo is also at the forefront of the conversation on artificial intelligence (AI) in ADR. He has served as a moderator and/or featured speaker on panels exploring the impact of AI on employment law and workplace responsibility, and conceived and hosted one of the first live “human-versus-AI” mediation competitions, pitting his own skills against several generative AI platforms to test whether machines can replicate the nuances of facilitated negotiation. The program has since been staged in more than half a dozen capital cities on four continents, sparking lively debate among practitioners, policymakers, and technologists about the responsible integration of AI into dispute resolution processes.

Organizations grappling with high-value disputes, whether domestic cases in New York or complex cross-border matters abroad, consistently rely on Mr. De Palo for mediation strategies that keep commerce moving and preserve critical relationships. His speaking engagements include presentations before the New York City Bar Association (Labor & Employment Committee, In-House Counsel Committee), the Federal Bar Association (FBA), the Silicon Valley Arbitration and Mediation Center (SVAMC), the Association for Conflict Resolution (ACR-GNY), Columbia Law School, Cardozo Law School, and the Center for Law and Technology at Berkeley Law, as well as cross-border and international law conferences worldwide including London International Disputes Week, the American Bar Association International Law Section Annual Conference, and California International Arbitration Week, among others.
  • Prolific author, and recipient of Mondaq Spring 2026 Thought Leadership Award, whose articles have appeared in the New York State Bar Association’s New York Dispute Resolution Lawyer, The American Lawyer, The New York Law Journal, Reuters Legal News, Mealey’s International Arbitration Report, Mondaq, and ALM|Law.com and/or been translated into multiple languages.
  • Seasoned ADR professional who is also frequently engaged at early stages and in post-incident contexts, assisting organizations and individuals in addressing conflict before escalation or in restoring—or, where necessary, responsibly concluding—working relationships after disputes have surfaced.

  • Mediated an international bankruptcy dispute involving a jurisdictional issue between two European Union (E.U.) member states and a non-E.U. country

Business & Commercial

  • Served as party-appointed arbitrator in an international commercial arbitration involving a shareholder agreement dispute with parties from three different jurisdictions, addressing alleged violations of contractual noncompetition provisions relating to electric vehicles
  • Mediated an international commercial dispute within the automotive industry encompassing parties from Belgium, Italy and Germany and involving the effectiveness of braking systems between a supplier of semi-final parts and the intermediary supplier delivering to car manufacturers
  • Conducted a facilitative settlement of an international commercial dispute concerning the performance of a large bottling plant situated in Saudi Arabia that was turnkey delivered by an Italian manufacturer
  • Arbitrated an alleged breach of an international agency agreement regarding mine exploitation rights
  • Mediated a distribution dispute between a primary car manufacturer and the suppliers of certain electrical components
  • Mediated a multimillion-dollar lawsuit between train operators over customer access to shared platforms and pathways in major train stations
  • Conducted a facilitative settlement in a dispute between a Portuguese bottling company, an Italian water supplier and a major U.S. grocery chain regarding alleged product liability issues, including product recall and libel

Consumer Law

  • Mediated hundreds of disputes between one of the largest U.S. banks and consumers who were charged fees for allegedly unwanted financial products and services
  • Appointed arbitrator in three related cases involving constitutional law issues arising from the dormant commerce clause and the prevalence of state law consumer credit policy over contractual choice of law

Employment Law

  • Mediated the departure of the managing director of a major international financial institution in connection with its acquisition by another international institution
  • Mediated a religious discrimination case against the senior leader of an international organization for hampering the career of a senior director from a different religion
  • Mediated a sexual harassment claim against a senior leader of an international organization for mistakenly sharing inappropriate pictures
  • Mediated a gender-based discrimination case against the senior leader of an organization for alleged harassment and discrimination
  • Mediated a sexual assault case against a military commander by a civilian staff member during peacekeeping operations
  • Mediated a series of retaliation claims arising from alleged favoritism in a competitive promotion process, involving an improper relationship between a supervisor and selected candidates and challenges to the integrity of the selection process
  • Mediated a race discrimination dispute involving competing statistical and performance-based evidence, where workforce data suggested disparate impact while documented performance evaluations and selection criteria supported the challenged promotion decisions
  • Mediated a workplace dispute in parallel with an ongoing internal investigation, coordinating with investigators to sequence the mediation phase where both the respondent and Human Resources were amenable to resolution notwithstanding an incomplete factual record
  • Mediated a retaliation dispute involving a senior official following the public release of a report critical of the organization, where ensuing media coverage required careful management of reputational risk and external scrutiny throughout the mediation process
  • Mediated an internal governance dispute within an employee representative body, where breakdowns in internal processes generated significant conflict and impaired the organization’s ability to negotiate with the employer, and served in a neutral capacity to oversee the election of new representatives
  • Mediated an employment dispute involving allegations of reverse discrimination and harassment, where a senior employee engaged in repeated, widely circulated accusatory communications directed at a supervisor, giving rise to claims of a hostile work environment and lack of managerial support, with atypical power dynamics stemming from differing contractual relationships and significant organizational impact

  • Mediated a  multi-party dispute arising from alleged damages to a large agricultural cultivation field caused by the purported malfunctioning of a solar-powered irrigation system, involving competing claims among the developer, installer, and landowner regarding liability, causation, and compensation for crop and land losses
  • Mediated a dispute arising from the revocation of tax credits and its consequential impact on the underlying contractual relationships among the parties, involving claims relating to material adverse change, allocation of risk, and the parties' respective rights and obligations following the loss of the anticipated fiscal benefits

Financial Markets

  • Mediated a related series of multimillion-dollar, complex disputes concerning the lawfulness of sophisticated financial instruments issued by U.K.-based banks to finance Italian local municipalities

Insurance

  • Mediated insurance disputes involving large, self-insured hospital systems, addressing complex issues arising from overlapping internal risk-retention structures and the allocation of coverage responsibilities across those schemes
  • Mediated a cross-border maritime insurance dispute concerning alleged duties of intervention and mitigation by insured parties, involving complex questions of policy interpretation, loss containment obligations, and the applicability of competing legal frameworks
  • Mediated an insurance coverage dispute arising from the construction of a large-scale military facility, involving multiple contractors and complex issues concerning the allocation of coverage and the applicability of different policies to discrete elements of the project

  • Mediated an international dispute regarding the alleged breach of licensing terms and intellectual property rights related to satellite dishes, involving parties from Israel, Italy and the United States
