Hon. Curtis M. Fiorini (Ret.) brings more than 30 years of legal experience to his work as a neutral, including more than 15 years on the Sacramento County Superior Court. During his judicial tenure, he served as supervising judge for civil settlements and conducted hundreds of settlement conferences involving personal injury, medical malpractice, business and commercial, commercial real estate, breach of contract, construction defect, lemon law and employment disputes. Judge Fiorini brings an engaged, practical approach to mediation, working closely with counsel and parties to assess legal and factual issues, evaluate risk and identify meaningful paths toward resolution.

Before taking the bench, Judge Fiorini developed substantial civil litigation experience representing both plaintiffs and defendants in business and commercial, employment, personal injury, property, and trusts and estates matters. At Jackson Lewis, he represented primarily national retailers in employment litigation, and at Damrell, Nelson, Schrimp, Pallios & Ladine, he handled civil matters from pleadings and discovery through mediation and settlement negotiations. He later served with the Sacramento County District Attorney’s Office, gaining significant trial experience and where his civil litigation background led to an assignment handling complex environmental litigation in the Consumer and Environmental Protection Division.

Judge Fiorini’s approach to dispute resolution is also informed by extensive trial and evidentiary experience and his work handling sensitive, high-conflict matters. During his judicial career, he presided over jury trials and evidentiary proceedings and served as presiding judge of the Domestic Violence Home Court. A longtime legal educator, he has taught at Lincoln Law School of Sacramento and UC Davis School of Law and has been recognized multiple times for excellence in teaching. His experience as a judge, civil litigator, advocate and educator enables him to identify the issues at the heart of a dispute while fostering a prepared, respectful and collaborative environment for resolution.

  • Conducted numerous settlement conferences involving Song-Beverly Consumer Warranty Act (Lemon Law) claims

Business Commercial

  • Conducted numerous settlement conferences for a wide range of business disputes, including various breach of contract claims involving partnership agreements, investments, loans and debt collection, fraud, defamation, declaratory relief, construction-related matters and intellectual property
  • Conducted settlement conferences over breach of contract, fraud and misrepresentation claims arising from commercial transactions across multiple industries, including disputes involving trade secrets, licensing agreements, confidentiality provisions and payment obligations
  • Conducted settlement conference involving trade secret dispute related to alleged misappropriation of confidential information, unfair business practices, breach of confidentiality agreements and related business tort claims
  • Conducted settlement conferences involving partnership, corporate and limited liability company disputes, including dissolution and business divorce matters, shareholder and board conflicts, derivative claims and breach of fiduciary duty allegations, as well as related accounting and valuation issues
  • As an attorney, handled business litigation, business transaction and property matters, including pleadings, discovery, motions, mediations and settlement negotiations, for plaintiffs and defendants

  • Conducted settlement conferences involving civil rights discrimination and disability access violations under the Unruh Act

Construction

  • Conducted numerous settlement conferences for a wide range of large construction defect matters, ranging from large projects, such as hospitals, gas pipelines and Olympic swimming pools, to residential properties
  • Conducted settlement conference involving fraud, conspiracy and disgorgement pertaining to construction project of a several-hundred-million-dollar building and involving over a dozen corporate parties and sureties

Employment Law

  • Conducted numerous settlement conferences in a wide range of employment disputes, including discrimination, sexual harassment, wrongful termination, civil rights violation and California Private Attorneys General Act (PAGA) allegations
  • Conducted numerous settlement conferences involving wrongful termination, discrimination and harassment claims under FEHA, Title VII and the ADA, including claims based on age, disability, gender, sexual orientation, pregnancy, race and national origin, as well as failure to prevent discrimination and failure to provide reasonable accommodations
  • Conducted settlement conferences involving wage and hour disputes, including claims involving meal and rest periods, overtime, waiting time penalties and PAGA allegations
  • As an attorney, represented national retail corporations defending employment-related disputes, including wage and hour, sexual harassment, discrimination and wrongful termination
  • As an attorney, represented plaintiffs in various employment matters

Environmental Law

  • As an attorney, handled complex environmental civil litigation for the Sacramento County District Attorney’s Consumer and Environmental Protection Division involving claims against oil companies and gas stations arising from alleged MTBE groundwater contamination

Estate Probate Trusts

  • Conducted settlement conferences involving contested will and trust disputes, including matters involving validity of testamentary instruments
  • Conducted settlement conferences pertaining to claims involving lack of capacity, undue influence and elder abuse, including challenges to amendments, transfers and estate planning instruments executed near the end of life

  • Conducted settlement conferences involving insurance coverage, bad faith, indemnity, subrogation and coverage disputes involving individuals, insurers and commercial entities
  • Conducted settlement conferences involving insurance matters arising from personal injury, wrongful death, property damage, construction defect, employment, business and real estate disputes, helping parties evaluate exposure and reach resolution

  • Conducted numerous settlement conferences in a wide range of personal injury actions involving automobile collisions, slip and falls, assaults, premises liability, negligence, workplace injuries, dog bites and product defects
  • Conducted settlement conferences involving catastrophic personal injury and wrongful death matters arising from motor vehicle, construction, industrial and recreational accidents, including multiparty and high-exposure cases
  • Conducted settlement conferences involving automobile, motorcycle, bicycle and pedestrian accident cases, including uninsured and underinsured motorist claims
  • Conducted settlement conferences involving premises liability and public property cases involving alleged dangerous conditions, roadway defects, unsafe construction zones and related public entity claims
  • Conducted settlement conferences involving sexual assault, child molestation, child abuse and related emotional harm claims, including matters involving public entities
