    Background and Education

    Daniel A. Platt, Esq., has been an arbitrator and a mediator since 2021 and has acted as a neutral in numerous matters involving health care payor/provider, commercial, real estate, consumer and ADA disputes. Prior to joining JAMS, Mr. Platt practiced for more than 35 years as a trial attorney focusing on complex commercial litigation matters, including health care, real estate, leasing, tax credits, food manufacturing, aviation, trade secrets and other business and contract issues.

    Mr. Platt has experience trying cases in both state and federal courts, regularly defending and prosecuting matters in the real estate, health care, ERISA, securities, consumer class action cases, aviation, banking and financial services, food manufacturing and processing, and hospitality industries. He has also represented clients in disputes involving partnerships, breach of contracts, securities, commercial leasing, trusts and estates, and employment. Mr. Platt has represented both health care providers and health care payors, and brings a strong understanding of both sides of the table to his ADR practice. He has extensive experience advising health care providers, third-party administrators and insurance providers in connection with claims involving denial of medical benefits, claims of underpayment, billing, unfair competition, breach of administrative services agreements, theft and misappropriation of trade secrets, improper termination of services contracts, coverage disputes, and employee benefit plan member and insured claims. Mr. Platt has experience litigating Medicare reconciliation matters, and he has represented medical device companies in various licensing agreement disputes.

    Mr. Platt applies a flexible approach to mediating disputes, ranging from facilitative to evaluative, depending on the facts, circumstances, parties and status of the case. His broad experience helps him to establish the trust and confidence of principals, carriers and counsel.

        • Arbitrated breach of contract dispute brought by an aircraft maintenance company against an airplane owner alleging failure to pay for services rendered. Respondent counterclaimed for overpayment and breach of implied covenant of good faith and fair dealing.
        • Represented parties in and served as Arbitrator for numerous breach of contract actions relating to lease, storage, charter, regulatory compliance and maintenance agreements. 
        • Represented commercial aviation trading companies regarding commercial jet parts, engines and engine part transactions 
        • Represented parties in and served as Arbitrator for disputes involving Fraud
        • Represented parties in matter involving breach of aircraft engine lease 
        • Represented parties in claim involving failure to accurately disclose condition of parts
        • Represented parties in matter alleging failure to provide full engine records

        • Mediated dispute involving claims for violation of Fair Credit Reporting Act (FCRA) and violation of CA Consumer Credit Reporting Agencies Act (CCRAA) 
        • Mediated matter alleging defamation against financial firm regarding purpose and reason for financial professional leaving firm after submitting Form U-5 to FINRA.
        • Mediated claim for breach of contract and breach of fiduciary duty against a law firm and its shareholders arising out of a stock purchase agreement.
        • Mediated breach of contract claim seeking the return of attorneys fees for failure to perform legal services and withdrawing as counsel immediately prior to trial.
        • Arbitrated dispute involving travel company’s alleged breach of contract in failing to reimburse full payment of fees for cancelled flight and cruise reservations, promissory estoppel, fraud, negligent misrepresentation and breach of implied covenant of good faith and fair dealing

        • Mediated dispute with claims against a church and certain members alleging elder physical and financial abuse, conversion of personal and intellectual property, violation of Penal Code 496, battery and negligence

        • Mediated dispute alleging violation of CA Penal Code, conversion, failure to pay all compensation due to discharge and failure to reimburse business expenses.
        • Arbitrated claim against major volunteer organization for harassment, retaliation, discrimination and wrongful termination.
        • Arbitrated numerous disputes involving wrongful termination, disability discrimination and disparate treatment, failure to engage in the interactive process and implement reasonable accommodations.
        • Arbitrated FEHA claim against restaurant for discrimination, failure to accommodate, retaliation, failure to prevent/remedy discrimination, interference
          with family rights leaves act and wrongful discharge
        • Arbitrated wrongful termination and FEHA claim involving wage & hour claims, discrimination based on race/national origin, failure to engage in interactive process and reasonable accommodations.
        • Arbitrated action against a former management employee to remedy alleged fraud, embezzlement and theft of Claimant's funds and breach of fiduciary duty and duty of loyalty.
        • Arbitrated and mediated single and multi-plaintiff wage and hour matters arising under the California Labor Code, California Wage Orders, and FLSA
        • Arbitrated matter involving whistleblower violations, discrimination, rest and meal break violations and late paycheck violations
        • Represented employers in numerous wrongful termination and discrimination cases

        • Arbitrated matter involving claims for failure to reimburse hospitals pursuant to contract rates for healthcare services provided to member-patients and/or patients whose care was Respondent's financial responsibility
        • Arbitrated dispute between medical center and health insurance company for breach of written agreement and Implied Covenant of Good Faith and Fair Dealing by improperly pricing, denying and/or underpaying claims.
