This course will explore the appropriate use of language in the context of gender including the care that must be employed in the use of language which could prejudice individuals appearing in the courts.

At the end of this session participants will
  • Understand how language impacts the outcomes in judicial opinion writing.
  • Learn how a writer can weaponize language to achieve a desired result.
  • Consider whether judges reverse engineer language for a desired outcome.
  • Explain why diversity on the bench is necessary to achieve a fair and just outcome.

How Detroit Resolved the Bankruptcy Crisis

Faced with a major American city in crisis, the legal system provided a solution and rescue plan using the laws, tools and processes of bankruptcy and high-level negotiation and mediation to formulate and implement numerous inter-party agreements, deals, swaps, investments and payments that resulted in the largest, most successfully-envisioned and completed municipal bankruptcy in U.S. history. Our panel served key roles in the process and will provide firsthand, interesting insights into how Detroit's "Grand Bargain" came together, the hurdles overcome to reach the bankruptcy plan and some background that you may not have heard.

At the end of the session participants will
  • Learn what factors led to Detroit's financial crisis and its resort to bankruptcy.
  • Understant how the bankruptcy process provided relief to Detroit and allowed Detroit to formulate a plan to survive and arise from its crisis.
  • Answer, "What was the "Grand Bargain?" and "Why was making that deal so important to the City of Detroit?"
  • Learn what role mediation and ADR had in formulating the Detroit bankruptcy plan and its emergence rom its financial crisis.
