Roundtable: The Supreme Court’s Ruling in Students for Fair Admissions v. Harvard: Insurance Coverage Implications for All Industries

After a brief background of the recent Supreme Court Students for Fair Admissions (SFFA) case on affirmative action, this roundtable will explore the expansion of the SFFA race-based decision and its impact on various insurance issues across industries. Areas of examination would include Harvard’s forfeiture of its secondary excess policy for coverage of attorneys’ fees and expenses associated with the SFFA case and how companies should consider the ruling during their policy reviews, including what constitutes a “claim” (giving careful consideration to communications received from a regulatory agency), EPL or education-specific policies, and potential modification of late notice provisions.
