Having a Senior Moment: A Nuanced Look at Family Law Issues in Gray Divorces

More and more we are seeing elder couples divorcing. Looking at the "Big Picture" perspective, top priority family law issues differ from those of younger couples, and often cross over to include estate planning issues . Judges Christine Byrd (Ret.) and Reva G. Goetz (Ret.) will discuss pre-filing concerns, including but not limited to review of existing estate plans and characterization of property as described therein, and fiduciary duties related to assets managed by each spouse. Other issues addressed will be spousal support and how the division of assets might impact that issue as directed by Family Code section 4322 and the holding in In re Marriage of Terry, and testamentary dispositions once a dissolution is finalized.
