JAMS neutral Hon. Frank Maas (Ret.) will join a panel discussion on March 18, “Ethical Considerations in Disclosure of Mediation Information.” This panel discussion will revolve around circumstances that could warrant disclosure of information received in mediations. These are issues which mediators and counsel encounter regularly and with which they grapple. Many are gray areas which the panel will discuss and debate.

Practitioners will gain information on the following key topics, including:

  • The mediation confidentiality landscape in NY State
  • Judicial examples of circumstances where mediation information may be shared and its limitations
  • Tools to address requests to share mediation information
  • Ethical consideration when privy to confidential mediation information
