Psychological Issues in the Workplace 2025
JAMS neutrals Stephen P. Sonnenberg, Esq. and Hon. Steven M. Gold (Ret.) will be among the speakers at Psychological Issues in the Workplace 2025. This program will address key employment law issues at the intersection of law and psychology. Harassment, discrimination and retaliation claims, among others, are profoundly impacted by the range of emotions that motivate employees and employers. So, too, are frequent claims involving disabilities and failure to accommodate. This program brings together a representative of the Equal Employment Opportunity Commission, prominent practitioners from the employee rights and management bars, psychologists, and a former federal magistrate judge to address the creation and litigation of today’s employment law claims. They will identify key legal issues and ways in which psychological factors influence the employees, managers and employers engaged in conflict. Stephen P. Sonnenberg, Esq. is co-chairing this program and will provide opening remarks, as well as lead a panel discussion, “2025 In Perspective: Update On Employment Claims And Psychological Factors In Litigation” at 1:15 PM. Hon. Steven M. Gold (Ret.) will join the panel discussion, “Ethical Tips and Traps When Lawyers Work with Forensic and Treating Mental Health Professionals” at 4:00 PM.
This session will help participants to:
- Understand the EEOC's, bar's perspective on recent discrimination, harassment and retaliation claims and defenses
- Understand the law on reasonable accommodations for employees struggling with mental disabilities, as well as the undue hardship defense for employers
- Distinguish the roles of forensic, treating and expert mental health professionals in employment litigation
- Understand the current status of DEI programs in the legal profession and identify the resources that remain available to organizations and lawyers interested in such programs
- Identify challenges facing lawyers who are neurodivergent or who struggle with mental health conditions
