How to Navigate Ethical Thickets

Conscientious and ardent representation of clients can lead practitioners into ethical thickets. JAMS speakers, Judge Chad Allred (Ret.), S. Karen Bamberger, Esq. and Judge Judith H. Ramseyer (Ret.) will employ hypotheticals and lead a discussion of practical ways to navigate these sticky situations. Topics will include:
- Ethical issues while using generative AI
- The use of listservs
- Drafting settlement agreements
- Failure to disclose that the plaintiff/client has died of unrelated causes before mediation
- Announcing a hard limit on settlement authority at the outset of mediation
- Failure to have a client present for mediation when the Neutral requires it
- Confidentiality
- Termination of legal representation
