Join JAMS Neutrals Carol A. Wittenberg and Jordana (“Jordy”) H. Feldman in our New York Resolution Center for an interactive CLE presentation that focuses on critical issues advocates encounter in mediating sexual abuse cases. The program will focus on the unique legal, ethical, and strategic considerations that distinguish these cases from other civil matters and will utilize hypothetical scenarios designed to elicit audience participation. Participants will gain insight into utilizing trauma-informed mediation techniques, assessing emotional distress, dealing with valuation challenges, articulating demands and counteroffers, and other practical tools for navigating emotionally charged negotiations while minimizing risk and promoting resolution. The panel will also address the special challenges faced when mediating multiple plaintiff assault cases.
The program will take place from 6:00pm - 7:00pm. A reception will follow the CLE presentation from 7:00pm - 8:00pm.
About the Panelists
Carol Wittenberg is a widely respected and nationally-known mediator and arbitrator with a distinguished career that has spanned over forty years. She possesses considerable experience resolving emotionally charged and sensitive sexual assault matters and has resolved hundreds of single- and multi-party and class action employment matters in a plethora of highly-publicized and high-stakes disputes. Among the disputes she has handled are also those involving federal, state, and local law discrimination claims, as well as matters involving hostile work environments, sexual harassment, retaliation, executive compensation, non-complete agreements, whistleblower allegations, and wrongful termination.
Jordy Feldman is a nationally recognized authority in the design, implementation and administration of high-profile victim compensation programs and a mediator in a wide range of disputes, including sexual abuse cases. She designed and served as the independent neutral administrator of the Epstein Victims’ Compensation Program, a voluntary, out-of-court program established to resolve sexual abuse claims against Jeffrey Epstein and his estate, and a similar program involving clergy sexual abuse claims. She previously served as Deputy Special Master of the September 11th Victim Compensation Fund (VCF) in the U.S. Department of Justice’s Civil Division. She has resolved thousands of claims involving catastrophic injury, death and sexual abuse against employers, medical institutions and religious organizations, and developed a first-of-its-kind law school course on victim compensation, with a focus on sexual abuse cases, which she teaches at NYU School of Law and the University of Pennsylvania Carey Law School.
