JAMS Announces New Artificial Intelligence Disputes Clause and Rules

New rules, first in the ADR industry, govern disputes involving artificial intelligence

Irvine, Calif.JAMS, the largest private provider of alternative dispute resolution (ADR) services worldwide, is pleased to announce it has created new rules governing disputes involving artificial intelligence (AI), effective immediately. The rules reflect the latest developments and trends in the ADR space and address the rise in usage and development of AI systems and smart contracts.

The JAMS AI Disputes Clause and Rules refine and clarify procedures for cases involving AI systems. This includes proper filing, service of the request for arbitration, commencement of the arbitration and service of documents throughout the arbitration. The rules expand the scope of the rules outlined for domestic arbitrations that involve new technology.

Additionally, the rules explicitly define "artificial intelligence" as “a machine-based system capable of completing tasks that would otherwise require cognition.” This definition and rules create a framework to support dispute resolution at a time when the evolving regulatory and governance environment for AI will have a significant impact on the legal industry.

By implementing these rules, JAMS aims to equip legal professionals and parties engaged in dispute resolution with clear guidelines and procedures that address the unique challenges presented by AI, such as questions of liability, algorithmic transparency, and ethical considerations. Key aspects of the arbitration procedures under the rules include the appointment and authority of a chairperson, the notice of claims, preliminary conferences and the exchange of information.
