*POSTPONED* 2022 Mid-Winter Meeting of the Fidelity and Surety Law Committee

Presented by the Tort and Insurance Practice Section (TIPS) of the American Bar Association (ABA)

The Fidelity and Surety Law Committee (FSLC) has decided to reschedule the 2022 Midwinter Meeting previously scheduled for next week in Nashville. The “Midwinter” conference has been moved to August 17-20, 2022, and will take place in Nashville, Tennessee. Nashville is even more vibrant and fun in the summer and we are hopeful that health concerns will be moving to our rearview mirrors. This also opens more opportunities for outdoor and/or open-air events.

ABA members with an interest or developed specialty in Fidelity and Surety Law are invited to attend the Midwinter Conference of the Tort and Insurance Practice Section of the American Bar Association. This three-day program will be hosted at the Grand Hyatt Hotel in Nashville, TN and feature a full day of construction programming, a full day of surety programming and a day and a half of fidelity programing.

Aggressive Advocacy or Unethical Bullying? - Where Is The Dividing Line And What Can Neutrals, Advocates And Clients Do When It Is Crossed?

Zealous advocacy is part of an attorney’s oath in the practice of law. When does this zeal cross the lines into bullying? The dividing line is murky. This panel discussion will focus on addressing ethical implications of such conduct by and between judges, attorneys, witnesses, and other parties to include understanding the balance between permissible advocacy and unethical bullying under the ABA Model Rules. Panelists will discuss these issues from the perspective of in-house counsel, trial counsel and the mediator/arbitrator, as well as concerns specific to trial, mediation and arbitration. Effective strategies to address these behaviors will also be explored.
