AI's Double-Edged Role in Dispute Resolution: When the Machine Tries to Solve the Dispute it Created

Join us for a live mediation simulation featuring an intriguing international dispute between AI Horizon and Quantum Cognition over the alleged malfunctioning of the Cognito+ platform (while all names were created by our imagination, the dispute will appear real indeed!)
 
AI Horizon, a major technology company, claims that Quantum Cognition’s platform has failed to deliver on its contractual promises, resulting in significant disruptions to Horizon’s operations and client services. On the other hand, Quantum Cognition insists that the issues were caused by improper integration and user errors on Horizon's side.
 
The mediator will have to untangle an intricate web of cross-border regulations involving the European Union, US, and China—covering the EU AI Act, Chinese data sovereignty, and US technology standards—as well as decode the different cultures of the litigants, each bringing their own approaches and expectations to the table.
 
Witness how a highly experienced human mediator manages these challenges in real time and see how different AI platforms might predict outcomes and advise on next steps. Can AI—both the creator of the problem and the proposed solution—outperform the human mediator? At the end of the simulation, participants—all seasoned international lawyers and ADR professionals—will explore the unique complexities of a similar case being taken to arbitration if neither AI nor a human can resolve it. Afterward, we will unwind and mingle over wine and cheese.
 
Program Format: The program will begin with a 30-minute mock mediation, simulating a complex dispute between AI Horizon and Quantum Cognition. Following the simulation, JAMS neutral, Giuseppe De Palo, Esq., will lead a 40-minute debrief session, during which participants will step out of their roles to share insights, reflections, and experiences from the mediation. The moderator will also demonstrate how different AI platforms might have mediated the same dispute. The program will conclude with a 20-minute discussion on the unique challenges of arbitrating a case like AI Horizon vs. Quantum Cognition, should mediation fail.
