Effective Use of Early Mediation: The presentation will focus on effective use of early mediation, specifically considerations on when to mediate employment disputes, how this may differ by type of case (wage and hour collective, trade secret, employment discrimination), how to overcome potential disadvantages by agreeing to exchange of critical information, pre-session preparation, and use of different techniques such as joint sessions and exchange of offers.
The presenters will also discuss effective arbitration advocacy, including how arbitration and court litigation differ, initial case conferences, use of efficiency in arbitration, summary disposition, hearing, and post-hearing advocacy.
