The newly launched nonprofit court of arbitration enables the fair resolution of aviation industry contract disputes

Irvine, Calif. – JAMS, the largest private provider of alternative dispute resolution (ADR) services worldwide, is pleased to announce neutral Gary Birnberg, Esq., FCIArb, has been appointed as chair of the Advisory Board for The Hague Court of Arbitration for Aviation (The Hague CAA). The Hague CAA, which launched July 20, 2022 on the main stage at The Farnborough International Airshow, is an innovative, nonprofit court of arbitration and center for mediation specifically designed for the global aviation industry.

The Hague CAA is seated in The Hague, Netherlands, with the Netherland Arbitration Institute (NAI) as its sole administrating body for disputes. A global team of nearly 70 diverse aviation and arbitration attorneys, executives and technical experts worked with the NAI on developing The Hague CAA. The team included representatives from more than 20 law firms, four law schools and nearly 30 aviation companies.

Gary is a skilled ADR professional who is adept at handling complex, international matters. His hands-on business experience across industries, paired with the significant role he plays in the international legal community, makes him an excellent choice for this role at The Hague CAA, and the court will truly benefit from having him on its leadership team.

The Hague CAA strives to enable the fair, expedited and cost-effective resolution of contractual disputes within the commercial and private aircraft industries. It is a private, nongovernment initiative, providing a neutral and private forum for consensual arbitration and voluntary mediation.

Birnberg is a seasoned ADR professional, specializing in the resolution of a diverse array of commercial matters, both domestic and international. He has served as mediator, arbitrator or special master in hundreds of disputes and is known for employing his legal acumen and business skills to quickly grasp the facts of complex cases. He is a U.S. citizen and permanent resident of Brazil, and is fluent in English, French and Portuguese, with conversational capacity in Italian and Spanish. He is active within the international legal community, staying current on local and international issues to continue his growth and add to his expertise as a neutral.
