Hon. Robert Foiles (Ret.) Joins JAMS in Silicon Valley

Former superior court judge joins JAMS as an arbitrator, mediator, special master/referee and neutral evaluator

Silicon Valley – JAMS, the largest private provider of alternative dispute resolution (ADR) services worldwide, is pleased to announce that Hon. Robert Foiles (Ret.) has joined its panel. Judge Foiles joins JAMS after serving nearly 27 years on the San Mateo County Superior Court.

For his last assignment on the bench, Judge Foiles served in the civil department, where he handled both general civil and complex matters, including personal injury, employment, commercial, real property, professional liability, government and construction defect cases. As a trial judge, he presided over nearly 150 civil and criminal jury trials, including numerous high-profile cases, and conducted over 1,000 mandatory settlement conferences as the civil settlement judge.

Based in the Silicon Valley Resolution Center, Judge Foiles will serve as an arbitrator, mediator, special master/referee and neutral evaluator, handling business and commercial, construction defect, employment, government/public agency, personal injury/torts, professional liability, real estate and real property, and probate, trusts and estates cases. He is available to conduct sessions in person, as well as virtually, for clients across the country.

Judge Foiles is known for his vast experience across many areas of the law and his pioneering work in creating San Mateo County’s first mental health court. He is an active member of the Northern California legal community and widely recognized for his work as a leading trial lawyer.

Judge Foiles was elected by his fellow judges as presiding judge from 2007 to 2008 and again from 2013 to 2014. After concluding his second term as presiding judge, he became the civil settlement judge, where he exclusively conducted all civil mandatory settlement conferences in the county from 2015 to 2018. From 2004 to 2006, Judge Foiles supervised the Civil Division, where he reformed the ADR and case management process. As assistant presiding judge in 2005, he wrote the protocol and helped establish Pathways, San Mateo County’s first mental health court.

My many years on the bench have helped me build a robust understanding of the factors—often incredibly complex—that can lead to disputes. One of the great joys of my career is having the opportunity to work alongside parties to help craft meaningful resolutions, and I look forward to continuing this work at JAMS.

Judge Foiles earned his B.S. from the University of California, Berkeley, and his J.D. from the University of San Francisco.
