Tariffs on Trial: Arbitration in the New Trade Era

Presented by JAMS, Ciarb and Ciarb Brazil Branch

Tuesday, November 18 | 2:00 – 4:00 P.M. | JAMS New York Resolution Center | New York Times Building

U.S. tariff and trade measures, often imposed with little warning, are reshaping global supply chains and fueling a surge of disputes. Companies face disrupted contracts, higher costs, and regulatory uncertainty that crosses borders and legal systems.

A panel of leading practitioners from the United States, Asia, Europe, and Latin America will then examine how tariff shocks and shifting trade rules are testing arbitration’s ability to resolve high-stakes disputes. Panelists will discuss strategies for addressing contract frustration, supply chain disruption, and regulatory shifts, offering perspectives on how arbitration can adapt to the volatility of international trade.

City Bar & CCA spotlight: SOL & PO 1

Tuesday, November 18 | 10:30 AM – 12:30 PM | NY City Bar Building | 42 West 44th Street, New York, NY 10036

Part I: Tick tock: cross-border insights on time bars in arbitration
Although limitation periods apply in arbitration proceedings, there is no universal approach to how it is determined, what limitation period applies, or how it will be enforced by tribunals. Building on a recent report by the New York City Bar Association’s International Commercial Disputes Committee exploring the nuances of how statutes of limitation are applied in U.S. arbitration practice (see here), this panel will explore different approaches to limitation issues across the globe. Speakers will provide insight on how parties and their counsel may enhance predictability in this area as well as considerations for arbitrators when they are presented with a defense that a claim is barred by a statute of limitations.
Moderator:
  • Boaz S. Morag, Counsel, Cleary Gottlieb
Speakers:
  • Julie Bédard, Partner, Skadden
  • Jose Sanchez, Partner, Vinson & Elkins
  • Professor Linda Silberman, Clarence D. Ashley Professor of Law Emerita, New York University School of Law
Part II: Charting the course: a deep dive into Procedural Order No. 1
The integrity, efficiency and cost-effectiveness of an international arbitration depends in no small measure on the quality of the Tribunal’s initial order establishing the procedures and timetable for the case. Done “right” Procedural Order No. 1 (“PO 1”) provides an accessible, transparent, steady reference point for all participants to the proceedings. This panel of experienced international arbitrators will examine the desirable scope and key elements of PO 1, share strategies for setting boundaries while respecting party autonomy, and explore how arbitrators and counsel can shape PO 1 to enhance the arbitration process.
Moderator:
  • Steven Skulnik, Independent Arbitrator
Speakers:
  • Gary Benton, Gary Benton Arbitration
  • Larry Schaner, Independent Arbitrator, Schaner Dispute Resolution
  • Conna A. Weiner, Esq., FCIArb, International Arbitrator & Mediator, JAMS

Power, Gatekeepers, and Representation: Who Really Shapes Arbitration?

Presented by ArbitralWomen

Thursday, November 20 | 8:30 – 10:00 AM | Reed Smith LLP | 599 Lexington Ave, New York, NY 10022

This session explores how institutions pave the way forward for appointing more women to panels (i.e., investing efforts to appoint a variety of females including non-partners to build the pipeline). We’ll also explore the double trouble women and diverse attorneys often face if not (yet) partners — receiving fewer or no appointments, and in parallel, not considered for partnership as early or as often as male counterparts.  A focus will be on how the role of arbitrator must be separated from the partner’s role, as the skills are distinct.  Themes to be explored include gender bias & discrimination, work-life balance (and availing oneself of modified work schedules to balance family), leadership gaps, and pay disparities.
Moderator:
  • Isabella Lorduy, Associate, Reed Smith
Speakers:
  • Laura C. Abrahamson, Esq., C.Arb., FCollArb, International Arbitrator & Mediator, JAMS
  • Eleanor Erney, Counsel, Hughes Hubbard & Reed
  • Ann Lesser, Diversity Co-Chair & Vice President of Labor, Employment, Elections, AAA-ICDR
  • Charlene Valdez Warner, Senior Associate, Barton
